GENERAL TERMS AND CONDITIONS OF SALE

1. Subject Matter
1.1 These General Terms and Conditions of Sale govern the contract of sale (hereinafter, the "Contract") entered into with users of the website (hereinafter, the "Buyer" or "Buyers") through online means, regarding the products (hereinafter, the "Product" or "Products") displayed on the website www.equipeboutique.eu (hereinafter, the "Website"), operated by RUMBA SRL, with registered office at Corso Europa 205, San Marcellino CE, 81030, VAT No. 02723980617 (hereinafter, "RUMBA").
1.2 The General Terms and Conditions of Sale published on the Website must be reviewed and acknowledged by the Buyer before purchasing a Product. By submitting the purchase order, the Buyer declares to have read and accepted them.
1.3 Buyers shall also benefit from the protections granted in the context of distance contracts, pursuant to Title III, Section II of Legislative Decree No. 206 of 6 September 2005 (the “Consumer Code”), as well as from all other mandatory protections granted to consumers under the same Consumer Code. 1.4 The sections “Shipping and Delivery”, “Return Terms and Conditions”, and “Prices and Payment Methods” published on the Website shall be considered an integral and substantial part of these General Terms and Conditions of Sale.
2. Conclusion of the Contract
2.1 To purchase Products, the Buyer must submit an order and make payment, following the procedures detailed in the dedicated sections of the Website.
2.2 Specifically, the purchasing process includes the following steps:
a) The Buyer may freely browse the Website and view the essential features of the Products displayed, including prices and illustrative images.
b) The Buyer may select one or more Products to purchase by adding them to a virtual "shopping cart". The cart can be reviewed at any time before placing the order and will display all relevant purchase information, including shipping costs and estimated delivery times.
c) To finalize a purchase, the Buyer must register an account by providing an email address and a personal password, which will allow future access to the Website.
d) Alternatively, purchases may be made as a guest, in which case the data required to process the order will be stored only for the duration necessary to complete the transaction. For each new order, the Buyer must re-enter the same data.
e) In the "cart" section, the Buyer must provide a shipping address and payment details to proceed.
f) The Buyer may modify the selected Products and the entered data until the final submission of the order by selecting the “Payment” button.
2.3 Payment may be made via credit card, PayPal, Klarna, Apple Pay, Amazon Pay, Meta Pay, or Google Pay. Further details are available in the “Prices and Payment Methods” section of the Website.
2.4 Upon receiving the purchase order, RUMBA will send a confirmation email to the Buyer including a summary of the order and will proceed with its fulfillment. The order will be deemed accepted—and the Contract concluded—upon the Buyer's receipt of the shipment confirmation.
2.5 The contract will be stored in PDF format and sent to the Buyer by email, and electronically archived by RUMBA.
2.6 RUMBA reserves the right to refuse orders or to deny service to anyone at any time.
3. Rights and Obligations of the Parties
3.1 RUMBA will deliver the Products to the shipping address provided by the Buyer in the purchase order, using a designated courier service.
Further details regarding shipping times, costs, and delivery areas are available in the “Shipping and Delivery” section of the Website.
3.2 RUMBA shall not be held liable for delivery errors due to inaccuracies or omissions in the purchase order submitted by the Buyer, nor for any damages incurred by the Products after delivery to the courier. Likewise, RUMBA is not responsible for delays in delivery due to the courier itself, weather conditions, customs procedures, or any other circumstances beyond RUMBA’s control.
3.3 If one or more Products are unavailable, RUMBA will notify the Buyer via email at the address provided during registration. In such cases, RUMBA will issue a refund through the payment method used at checkout, covering the price of the unavailable Product(s) and, if the order included only that item, the shipping costs as well. Subject to the Buyer’s consent, RUMBA may offer to send a different Product of equivalent value.
3.4 If designers make changes during production, decide not to produce certain items, or if a pre-ordered product is not delivered by the designer, RUMBA will contact the customer to request express approval before proceeding with the shipment or issuing a full refund.
3.5 In any event, the unavailability of one or more Products shall not constitute valid grounds for the Buyer to cancel the entire order.
3.6 Upon delivery of the Products by the courier, the Buyer must inspect the package in the courier’s presence and verify:
a) That the packaging is intact and not damaged or altered, including the sealing materials;
b) That the number and type of Products match the delivery document and the order placed.
3.7 If the Buyer identifies any anomalies or discrepancies, these must be reported immediately to the courier at the time of delivery.
3.8 The Buyer is solely responsible for the accuracy and truthfulness of the information provided to RUMBA and agrees to promptly notify any changes to the data previously submitted.
4. Product Compliance
4.1 RUMBA undertakes to ensure that the descriptions and/or photographic representations of the Products on the Website are as accurate as possible.
However, given that the image quality may vary depending on the Buyer’s device, it is possible that the Buyer’s perception of the Product description or image may not correspond exactly to the actual Product.
Therefore, all images and videos provided on the Website are intended for descriptive purposes only.
4.2 If the delivered Product is found to be defective or different from what was ordered, RUMBA guarantees the Buyer the right to legal warranty of conformity, as provided for under Articles 128 et seq. of Legislative Decree No. 206/2005 (Consumer Code).
In particular, the Buyer shall be entitled to request, at their discretion:
a) Delivery of a Product identical to the one ordered, subject to availability in stock, or
b) Delivery of a Product of equivalent quality and value, also subject to availability, or
c) A full refund of the price paid for the Product, including shipping costs
4.3 This warranty applies only if the Product has been handled with due care and in accordance with its intended use.
The Buyer must also provide the delivery note and order number as proof.
4.4 In any case, the warranty does not apply to defects resulting from normal wear and tear of the Product.
5. Right of Withdrawal
5.1 n accordance with the provisions of the Italian Consumer Code, the Buyer has the right to withdraw from the Contract without penalty and without having to state a reason, starting from the date of receipt of the order confirmation sent by RUMBA and for a period of fourteen (14) working days following receipt of the Product.
5.2 If the Buyer wishes to exercise this right of withdrawal, they must send appropriate written notice to RUMBA within the aforementioned 14-day period, starting from the date the Product was delivered.
5.3 In the event of withdrawal, the Buyer must also return the Product to RUMBA within two weeks from the date the withdrawal notice was sent.
5.4 Detailed information on the procedure and instructions for exercising the right of withdrawal, as well as related costs, are available in the “Return Terms and Conditions” section of the Website.
5.5 An essential condition for exercising the right of withdrawal is that the returned Product be substantially intact. The Product must be kept and handled with ordinary diligence and returned in a normal state of preservation.
5.6 In particular, Products must be returned:
a) Properly packaged in their original box, in resalable condition (i.e. not damaged, altered, or soiled), and with all accompanying accessories and documentation;
b) Along with the delivery note (found in the original packaging) so that RUMBA can identify the Buyer (order number, full name, address);
c) Without visible signs of prolonged use beyond what is necessary to try the item. Items must not show signs of wear that would compromise resale.
5.7 The costs of returning the Product shall be borne by the Buyer, as specified in the “Return and Exchange” section of the Website.
5.8 Upon proper exercise of the right of withdrawal under these General Terms and Conditions of Sale, RUMBA will refund the amounts paid by the Buyer using the same payment method used for the original order. The refund will be issued within 14 days from the date RUMBA is informed of the Buyer’s intention to withdraw.
5.9 If the Buyer fails to meet the conditions under Articles 5.5 and 5.6, the Seller reserves the right to deduct from the refund an amount corresponding to the diminished value of the returned Product, notifying the Buyer of this in writing.
The Buyer may then choose to reclaim the item, at their own expense, in the condition in which it was returned.
5.10 The right of withdrawal shall in no case apply to the following Products:
a) Customized items or goods that, by their nature, cannot be returned or are liable to deteriorate or expire rapidly;
b) Electronic devices, IT products, cosmetics, or perfumes that have been sealed and subsequently opened by the Buyer.
6. Data Protection
6.1 Personal data collected during registration and/or purchase, as well as any browsing data, will be processed by RUMBA SRL as Data Controller, in compliance with the applicable legislation on the protection of personal data, including Regulation (EU) 2016/679 (GDPR). 7. Miscellaneous
7.1 RUMBA reserves the right to modify these General Terms and Conditions of Sale at any time.
7.2 The General Terms and Conditions of Sale applicable to each Product purchase shall be those published on the Website at the time the order is placed.
The Buyer is therefore required to read and accept these Terms and Conditions before completing any purchase.
7.3 Should any provision of these General Terms and Conditions of Sale be deemed null or invalid, the remaining provisions shall remain fully valid and enforceable.
7.4 RUMBA’s mere tolerance or failure to contest any breach by the Buyer of these General Terms and Conditions of Sale shall not be interpreted as a waiver of RUMBA’s rights or as an implied acceptance of such breach, nor shall it modify the contractual terms agreed between the parties.

9. Governing Law and Dispute Resolution
9.1 These General Terms and Conditions of Sale are governed by Italian law and shall therefore be interpreted and enforced in accordance with it.

Promo Codes
Customers who have received a PROMO CODE via newsletter, through social media platforms, or on authorized promotional websites may enter the code during the order process or at checkout.
Each code has a defined start and end date, which determines its validity period and cannot be extended.
Order Processing
RUMBA reserves the right to refuse an order in the event that Shopify Payments does not receive approval from the customer's bank.
Once an order for available products has been placed, no changes can be made to that order.
Orders placed separately will be shipped separately.
RUMBA reserves the right to delay a shipment if the order cannot be dispatched for reasons beyond RUMBA’s control.
